
1. DEFINITIONS
In these Terms and Conditions all references to “Us” are to Vimto Soft Drinks a trading division of Nichols Plc, all reference to “You” are to you, the person who is placing an order for goods.
2. GENERAL
All contracts for the sale of goods by us shall be subject to these Terms and Conditions.
3. ORDERS
(a) You place an order for goods by completing the order form which will automatically be sent to us. You can either pay by
i) personal cheque (with cheque guarantee card number and order number printed on the reverse) for the full cost of your order. Please send to Vimto Soft Drinks, Merchandise section, Laurel House, Ashton Road, Newton Le Willows, WA12 0HH
ii) or complete the online credit card form with your debit / credit cards details
(b) Our acceptance of your order is subject to the goods being available.
(c) We can only accept orders from and deliver goods to addresses within the United Kingdom.
4. PRICES
All goods will be supplied at our prices shown on the Panda merchandise website at the date of despatch. We reserve the right to change these prices from time to time.
5. PAYMENT TERMS
Payment must be made in full and submitted with the order form. Goods will only be despatched to you once your cheque has cleared, or your cards payment has been accepted.
6. DELIVERY
(a) We will ensure your goods are delivered to you within 3 working days of receipt of your order if you pay by debit /credit cards or provided your cheque guarantee number is on the reverse of your cheque and that the goods are available.
(b) If your cheque does not have the guarantee number on the reverse then we will ensure your goods are delivered to you within 28 days of receipt of your order provided that the goods are available and that your cheque has cleared.
(c) If some of the goods on your order form are not available then we will send those goods that are available and the remainder will be sent to you as soon as they become available.
7. UNSATISFACTORY GOODS
8. OUR LIABILITY(a) If You are not completely satisfied with your Panda merchandise then please return them to us, within 28 days of receipt, telling us why you are not satisfied with them and we will replace them.
(b) Goods returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us
8.1 We warrant to you that any goods purchased from us are of satisfactory quality.
8.2 Our liability in connection with any goods purchased by you is strictly limited to the purchase price of that particular item.
8.3 This does not include or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability
9. RISK
The goods will be at your risk from the time of delivery.
10. DATA PROTECTION
We are registered as a Data Controller under the Data Protection Act 1998. We undertake only to use personal data in accordance with the Data Protection Principles.
11. GOVERNING LAW
These Terms and Conditions of Sale and all contracts for the supply of goods by us shall be governed by and construed in accordance with English Law, and we both agree that the English Courts shall have exclusive jurisdiction to determine any dispute arising from or connected with this Agreement.
